Computer intrusions have been known to take down complete systems in many different organizations. Sometimes it is another organization knocking the competition out for a while. Other times it is someone wanting to brag that they hacked into a major system and disrupted things and made the system crash.</p>
<p>Child pornography is growing at a rapid place on the internet. With the child pornography there are more pedophiles that are showing up on the internet. The pedophiles are trying to lure children in to meeting them. If a child is going to be on the internet it is always best to take precautions and restrict where they can and cannot go. This will help to keep them safe from lurking criminals.</p>
<p>These are just a few of the internet crimes that are committed around the clock. There are laws in place to handle internet crimes. These crimes are dealt with just like a crime that was not committed on the internet. There will be steep fines and even jail time if a persons is caught doing any type of crime on the internet.</p>

In the United States, it is illegal to own child pornography or to solicit a minor for sex. However, this has also been on the rise due to predators on the Internet taking advantage of young, naive people.</p>
<p>Finally, a person can cyber stalk someone by causing their computer equipment to malfunction. This occurs when a person sends out a type of virus known as spyware. Spyware allows a person to monitor a person&#8217;s use of their computer and can give them access to private files and information about their victims. In most cases, spyware can manifest itself by opening up unwanted email messages.</p>
<p>Cyber stalking comes in many forms, but each form revolves around a person&#8217;s unlawful use of a computer that is connected to the Internet. Its definitions range from people openly harassing others, soliciting minors for sex, or sending out spyware to monitor a computer. It is up to each state legislature to pass new laws that will enable all of these cyber predators to be brought to justice.</p>

<p>With the growth of the internet, network security has become a major concern. Cyber criminals are doing every thing from stealing money, hacking into others computer, stealing intellectual property, spreading viruses and worms to damage computers connected on the internet and committing frauds.<br />
Stoppage of cyber crimes is a major concern today.<br />
Cyber criminal make use of the vulnerabilities in computer soft wares and networks to their advantage.</p>

<p>Hacking or Cracking is a major cyber crime committed today. Hacker makes use of the weaknesses and loop holes in operating systems to destroy data and steal important information from victim&#8217;s computer. Cracking is normally done through the use of a backdoor program installed on your machine. A lot of crackers also try to gain access to resources through the use of password cracking softwares. There are cyber laws at the FBI, FCC, SEC, FTC and many other places cropping up. What is unfortunate indeed is that most of these laws are made to protect US Citizens and yet only enforced onto US Citizens.<a href="http://www.eduinchon.net/wp-content/uploads/2012/01/Cyber-Law.jpg"><img class="align right size-full wp-image-748" title="Cyber-Law" src="http://www.eduinchon.net/wp-content/uploads/2012/01/Cyber-Law.jpg" alt="" width="300" height="199" /></a> We have Identity Theft Laws, Child Porn, SPAM, Phishing and Hacking Laws and yet in reality most of the criminals who specialize here are not US Citizens and do not live in the US.</p>
<p>Perhaps as the Internet Started those sorts of criminals were from here, but not anymore, as the United States has been cleaning up its act. Now these criminals come from other countries and the Internet knows no bounds. They hide in far away countries and host their websites in far away cities, half way around the world and they prey on the US Citizens. Our Cyber Laws cannot protect the American People in this case.</p>
<p>Then there are those harassing slander laws, which seem to be selectively enforced as well. Even the government itself slanders citizens on the Internet accusing them of things they did not do or purporting their side of the case in self-aggrandizement prior to any court of law. It appears that in the future all these issues must be addressed other wise any cyber laws, which are made are never going to stop the crime being committed. Consider all this in 2006.</p>

			<content:encoded><![CDATA[<p><strong>Cyber law</strong> in education is an issue that is ripe for scholarly research and analysis.  The importance of this topic is growing <a href="http://www.eduinchon.net/wp-content/uploads/2012/01/images1.jpg"><img class="alignright size-full wp-image-741" title="images" src="http://www.eduinchon.net/wp-content/uploads/2012/01/images1.jpg" alt="" width="240" height="159" /></a>exponentially with the meteoric rise in social networking and other online forums which are becoming a primary source of interaction among school aged students. One result of these &#8220;virtual&#8221; relationships is a blurring of the lines of jurisdiction for disciplinary responsibility. At what point do a student&#8217;s actions fall outside of the authority of his or her school?</p>
<p>When the student uses school equipment on school grounds the analysis is very clear, but case law has created a continuum that defies any objective definition of where that jurisdiction ends. Similarly, at what point does a teacher or administrator&#8217;s actions leave the authority of their employer and become protected by their right to privacy? The question of jurisdiction must be addressed before meaningful processes can be implemented to counteract the damage that online actions can have on the school system.</p>
<p>The harms that are caused at the hands of students through cyber actions include marring the reputation of teachers and administrators, harassing other students and threatening the security of testing and other educational information. Similarly, educators often cause harm through their own cyber actions by using online forums in an inappropriate manner to the detriment of their school or district.</p>
<p>These actions may compromise the safety and morals of their students and affect the integrity of the educational system itself. Yet any restriction on these actions runs the risk of violating constitutional rights of free speech and privacy. Needless to say, there is a careful and ever-evolving balancing process that needs to be maintained in this area of law. And the decisions of our courts and enactments of our legislatures must be monitored and influenced by educators and education law experts.</p>

A partnership has been formed with the FBI&#8217;s Internet Crime Complaint Center (IC3 formerly known as the Internet Fraud Complaint Center IFCC) and the National White Collar Crime Center (NW3C) for the combined objective of identifying and bringing to justice those responsible for online internet fraud.<a href="http://www.eduinchon.net/wp-content/uploads/2012/01/fbicc1.jpg"><img class="alignright size-full wp-image-730" title="fbicc" src="http://www.eduinchon.net/wp-content/uploads/2012/01/fbicc1.jpg" alt="" width="270" height="186" /></a></p>
<p>The FBI-IC3&#8242;s stated Mission regarding Cyber Crime is &#8220;to serve as a vehicle to receive, develop, and refer criminal complaints regarding the rapidly expanding arena of cyber crime.&#8221; The IC3 provides the victims of cyber crime with an online reporting form that will be used to alert authorities of suspected criminal or civil violations. IC3 also provides their law enforcement partners and regulatory agencies at the federal, state, local and international level the internet related crime with information gathered through complaint forms to this centralized referral system.</p>
<p>In addition to partnering with law enforcement and regulatory agencies, it will remain a priority objective of the IC3 to establish effective alliances with industry. These alliances will enable the IC3 to leverage both the intelligence and subject matter required in identifying and crafting an aggressive, proactive approach to combating cyber crime.</p>
<p>IC3 accepts online Internet crime complaints from either the person who believes they were defrauded or from a third party to the complainant can best be processed if accurate and complete information accompanies the complaint. Breaking the law online is as serious as breaking the law offline.</p>

<p>The law that the social media users broke was the Serious Crime Act 2007. Although the law was not set up to cover the use of social media, the use of social media was much lower in 2007 than it is now, the law of the land applies online to the same degree that it does off line.</p>
<p>The Serious Crime Act 2007 states that either &#8220;intentionally encouraging or assisting an offence&#8221; or &#8220;encouraging or assisting an offence believing it will be committed&#8221; is viewed as being as serious as carrying out the act itself. So if you post a Facebook message encouraging people to riot and loot then it viewed the same in the eyes of the law as if you were rioting and looting yourself.</p>

<p>Defamation and libel laws apply to the online world in the same way that they apply to more traditional forms of print media, TV and radio. If you slander someone online without being able to prove it then you can be open to being sued for libel.</p>
<p>You may think that something you post about an individual of company may well be lost in the billions of webpages in cyberspace. This is not the case as many individuals and companies actively police what is said about them online. Many will issue civil proceedings if they feel the statements are defamatory.</p>
<p>The cyber smearing does not have to take place on a website you own for you to be open to being sued. If you have smeared someone using social media, message boards, forums, review sites, auction sites or email then you are open to being pursued for libel damages.</p>
<p>You also do not need to be the originator of the rumour. If you simply repeat the allegations then you can be sued. It is very foolish to just repeat allegations without double checking that they are true. A re-tweet of somebody else&#8217;s link to a post about a rumour can place you in line for being sued. It is also worth noting that you cannot defame someone using their nickname and thing you are safe if the nickname is well known by the public.</p>
<p>Attempting to hide behind an anonymous username is also no protection from the law.</p>
<p><strong>Difference between Slander and Libel</strong></p>
<p>A landmark ruling in August 2008 by Mr Justice Eady drew a distinction between de Defamatory comments on internet bulletin boards and forums and those published within articles on websites. The Judge stated that those on internet bulletin boards were more likely to be slander and not libel.<br />

What is unfortunate indeed is that most of these laws are made to protect US Citizens and yet only enforced onto US Citizens. We have Identity Theft Laws, Child Porn, SPAM, Phishing and Hacking Laws and yet in reality most of the criminals who specialize here are not US Citizens and do not live in the US.</p>
<p>Perhaps as the Internet Started those sorts of criminals were from here, but not anymore, as the United States has been cleaning up its act. Now these criminals come from other countries and the Internet knows no bounds. They hide in far away countries and host their websites in far away cities, half way around the world and they prey on the US Citizens. Our Cyber Laws cannot protect the American People in this case.</p>
<p>Then there are those harassing slander laws, which seem to be selectively enforced as well. Even the government itself slanders citizens on the Internet accusing them of things they did not do or purporting their side of the case in self-aggrandizement prior to any court of law. It appears that in the future all these issues must be addressed other wise any cyber laws, which are made are never going to stop the crime being committed.</p>

Partly due to lack of knowledge within the general consumer, offenders insinuate themselves into havens previously thought to be safe and sound. As the computer becomes a conduit to a whole new horizon of experiences and information, it can also allow unhealthy elements to enter if proper defenses are not put in place. Individuals, young and old, become targets for all sorts of perpetrators as they unknowingly release information about themselves. It then becomes easy work for the offenders to close in for the kill, so to speak.</p>
<p>In a different slant away from offence to the physical body, property theft in the form of copyrights and identities reign high in the world of cyber crime. To address the former, various laws are formulated to protect the individual&#8217;s rights. In the event such a violation is detected, due process needs to be carried out in order to prove any illegal doings and consequences thereafter. Phishing is also gaining speed as these crime fighters do the necessary to shut down such activities as well as push the need for the public to be better educated.</p>
<p>Those interested to pursue academic advances in this area need to be well-versed in computers and the like to make effective contributors to lowering crime rates and property theft of the physical and virtual kind. Although the older generation of law enforcers may feel intimidated with the gadgetry and terminology associated with technology, it is an imminent fate for all to join the broadband of brothers. As it complements conventional law enforcement rather than compete with it, study into the field of cyber crime allows one to learn the ways and thoughts of the criminally yet technologically inclined. Records of offenders are entered into computer systems to constantly monitor their activities and enable extensive searches based on their profiles thus resulting in more efficient means of fighting crime.<br />
